A side-impact investigation has at least two different questions. Traffic-control, movement, and right-of-way evidence help reconstruct why the vehicles collided. Vehicle deformation, restraints, occupant position, and interior contacts help explain how forces reached a particular occupant. Mixing those questions can hide important gaps.
Right-of-way evidence explains how vehicles reached the collision; intrusion and occupant evidence address what happened inside the struck vehicle.
Preserve the struck side before repair or disposal
- VIN, make, model, year, trim, body style, door configuration, options, recalls, prior damage, modifications, and repair history
- Struck door, hinges, latch, striker, sill, pillars, roof rail, floor, seat mounts, console, glazing, trim, side air bags, curtain air bags, and debris
- Exterior and interior photographs with scales, three-dimensional measurements when appropriate, crush profile, intrusion, separation, scrape direction, and contact marks
- Tow, storage, insurer, appraiser, repair, auction, salvage, purchaser, inspection, access, and each transfer of custody
- A written inspection protocol that starts with nondestructive work and records any removal, cycling, testing, alteration, repair, or disposal
Use the federal side-impact standard as context
Federal Motor Vehicle Safety Standard 214 specifies side-impact protection requirements for covered vehicles. It addresses subjects including door crush resistance, moving-deformable-barrier testing, vehicle-to-pole testing, door opening, and measured responses of instrumented test dummies.
A compliance test and a real collision are not the same event. Vehicle type, weight, manufacture date, seating position, impact location and angle, striking object, speed change, prior condition, repair, and occupant characteristics all matter. Compliance or noncompliance cannot be inferred from photographs alone.
Map the occupant and restraint evidence
- Exact seat, seat-track position, seat-back angle, head-restraint position, occupant size, posture, clothing, and carried objects
- Belt use, webbing position and marks, retractor, buckle, latch plate, anchor, pretensioner, load limiter, and rescue cuts
- Side and curtain air-bag deployment, occupant-classification or warning information, window position, glazing, and possible ejection path
- Head, torso, pelvis, arm, leg, and other contact locations compared with interior marks, intrusion, medical findings, and rescue records
- Driver and passenger accounts kept in their own words, without asking witnesses to adopt an engineering or medical conclusion
Preserve short-duration vehicle data
49 C.F.R. Part 563 establishes requirements for covered vehicles equipped with event data recorders. Depending on the vehicle and event, a file may contain data about vehicle dynamics, driver inputs, crash severity, restraint status, or system deployment.
NHTSA’s event-data-recorder resource explains that an EDR captures technical data for a brief period around a crash. Confirm the module, supported data elements, trigger, number of events, power cycles, overwrite risk, retrieval tool, software version, technician, native file, report, and file hash. An EDR is not a continuous video and does not replace scene or vehicle evidence.
Test the injury mechanism without assuming it
Door intrusion, a deployed air bag, a belt mark, or a diagnosed injury does not independently establish the complete causal sequence. Compare the vehicle motion, direction and depth of crush, occupant position, restraint performance, interior contacts, timing of symptoms, medical findings, and alternative explanations. Keep medical and engineering opinions within the witness’s qualifications.
