A crash may occur in a company car, a rented vehicle, or an employee’s personal vehicle while the driver travels between sites, makes a delivery, attends a meeting, responds to a call, or completes an errand. The vehicle label and time of day are useful facts, but they do not fully describe why the trip occurred.

A company logo or workday timestamp does not establish the trip purpose by itself; the record should connect the driver, vehicle, task, route, employer direction, business benefit, and any personal deviation.

Identify every work and vehicle relationship

  • Driver, employer, payroll entity, staffing company, supervisor, customer, contractor, vehicle owner, lessee, renter, insurer, and person who supplied the keys
  • Job title, assigned duties, work location, shift, compensation method, mileage or expense policy, and ordinary travel expectations
  • Vehicle title, registration, lease, rental agreement, permission, maintenance, garaging, fuel card, telematics, and insurance
  • Who selected the route, deadline, destination, passenger, cargo, equipment, and stop
  • Exact legal names and source records rather than a logo, uniform, or verbal description alone

Build a trip-purpose chronology

  • Clock-in, assignment, dispatch, departure, stops, collision, employer report, medical care, and return or removal from duty
  • Origin, planned destination, actual route, business task, customer or site, expected completion, and next assignment
  • Call, text, email, app, schedule, work order, calendar, receipt, toll, access, fuel, GPS, and vehicle-system record
  • Meal, commute, personal errand, route departure, passenger, off-duty period, or other disputed deviation kept explicit
  • Who knew about or approved each change and what happened before the driver resumed any work task

Preserve employer notice and the Commission file

G.S. 97-22 addresses written notice of an accident to the employer, including its timing language and stated exceptions. Preserve the oral report, written notice, recipient, delivery proof, incident report, supervisor response, and any reason for delay.

The North Carolina Industrial Commission forms page identifies Form 18 as the employee’s notice and claim form. Keep the filed form and confirmation separate from an employer report, insurer claim number, medical authorization, or payment.

Keep the collision investigation independent

  • Roadway, traffic, weather, vehicle movements, witnesses, report, photographs, video, physical evidence, and electronic data
  • Conduct attributed to each driver and evidence for and against it
  • Vehicle condition, maintenance, load, schedule, device, fatigue, supervision, or another company issue only when supported
  • Medical baseline, event mechanism, symptoms, diagnoses, treatment, restrictions, function, and qualified causation evidence
  • Each policy and coverage position kept separate from responsibility

Separate the two claim paths

G.S. 97-10.2 addresses third-party rights and remedies when the circumstances creating third-party liability also involve workers’ compensation benefits. The statute includes procedural rights, timing, interests of the employer or carrier, distribution, costs, and lien treatment. Its application should be reviewed before any settlement or release.

  • Workers’ compensation: employer, carrier, Commission file, accepted or denied issues, authorized care, wage records, benefits, agreements, and orders
  • Civil claim: responsible parties, fault evidence, insurance, medical causation, losses, defenses, filing, service, discovery, offers, and releases
  • One shared event chronology with separate status, payment, deadline, and settlement ledgers
  • No assumption that payment on one path closes, proves, or preserves the other
