The opening month of a car-accident legal file is used to define the work, identify urgent dates, preserve sources, map participants and insurance, organize medical and loss records, and establish communication. The order may change when safety, evidence loss, filing, service, or another time-sensitive issue requires earlier attention.

The first 30 days are an organizational window, not a legal deadline or a promise that investigation, medical development, insurance review, settlement, or litigation will be complete within a month.

Day one: confirm the relationship and communication route

  • Client, lawyer, law firm, adverse and related parties, matter description, event date, and conflict-check names
  • Signed agreement, scope included and excluded, fee and expense terms, settlement authority, withdrawal or discharge provisions, and complete copy delivered
  • Responsible lawyer, staff contacts, routine and urgent channels, office hours, accessibility or language needs, and backup contact
  • Preferred update frequency, client questions, decisions reserved for the client, information needed from the client, and response expectations
  • Privacy, secure document transfer, people authorized to receive information, and limits on communicating through family, employers, providers, or other third parties

Open an urgent-date register

Record possible statutes of limitation or repose, notice requirements, policy duties, evidence overwrite or disposal dates, vehicle repair or salvage, record-retention periods, offers or releases, court dates, and other asserted deadlines. Each entry should identify the source, trigger, tentative calculation, reviewer, earlier operational date, assigned person, and completion evidence. Do not rely on a generic calendar entry without the underlying authority or document.

Create a source-preservation plan

  • Crash report, photographs, video, audio, witness information, messages, phone or app data, vehicle condition, repair material, roadway evidence, and physical items
  • Current custodian, native format, metadata, access authority, retention or overwrite period, request or notice sent, response, and follow-up date
  • Original file or object separated from working copies, annotations, summaries, and converted formats
  • Known gaps, conflicting versions, unavailable material, changed condition, and any question requiring an inspection or court process

Map parties, policies, and roles

List drivers, owners, occupants, employers, contractors, government entities, manufacturers, property controllers, witnesses, insurers, lienholders, and other participants without assuming responsibility. For every insurance contact, preserve the carrier, policy or claim number, coverage part, insured, adjuster, correspondence address, reservation, request, decision, payment, and unresolved issue.

Build medical and loss indexes

The medical index should identify providers, dates, records requested and received, clinical questions, bills, health or medical-payments processing, restrictions, prior conditions, and later events. The loss index should identify property damage, towing, storage, transportation, work and wage records, household assistance, expenses, and source calculations. A lawyer should not make a medical diagnosis or substitute a file summary for the clinical record.

Use the file to support competent and diligent work

North Carolina Rule of Professional Conduct 1.1 addresses competent representation. Rule 1.3 addresses diligence and promptness. The opening file should identify what is known, what remains unknown, which legal and factual questions require research or investigation, and who owns each immediate task.

Issue a written initial status review

Rule 1.4 addresses information, consultation, status, requests, and explanation. The initial review can state the scope, current facts, sources received, urgent dates, tasks completed, open requests, disputed issues, decisions needed, next steps, and next update date. It should preserve uncertainty rather than state unsupported conclusions about fault, causation, coverage, value, or outcome.
