Intersections compress turning, crossing, merging, stopping, and through movements into a small area. Bicycle crashes commonly involve a driver turning across a rider’s path, a rider entering from a sidewalk or trail, limited sight distance, a signal phase, or disagreement about lane position and timing.
An intersection crash can involve driver conduct, rider conduct, signal operation, sight restrictions, and design at the same time. The investigation should preserve each possibility before deciding which one explains the conflict.
Create a phase-and-path diagram
- Every approach, lane, bicycle lane, shoulder, sidewalk, trail connection, crosswalk, stop bar, median, and driveway
- Rider and vehicle starting points, intended destinations, directions, paths, impact, and final positions
- Traffic-signal faces, turn arrows, detection equipment, signs, markings, obstructions, lighting, and grade
- Estimated and measured times, speeds, distances, braking, steering, and visibility from each participant’s position
Apply the rule to the actual signal and movement
G.S. 20-158 addresses stop signs, traffic signals, stop locations, yielding, right turns on red, and malfunctioning signals. It also states that failure to stop under the section is not negligence per se, while allowing the related facts to be considered with the other evidence.
G.S. 20-154 requires safety before starting, stopping, or turning and governs signaling, including a bicycle right-turn signal option. Identify whether the dispute involves an omitted signal, an unsafe movement, inadequate observation, or a different account of the path.
When a rider approaches on a sidewalk or walkway across a driveway or building entrance, G.S. 20-173(c) requires the driver emerging from or entering the driveway to yield to a pedestrian or person riding a bicycle approaching on that sidewalk or walkway. Other intersection paths may invoke different provisions.
Secure the electronic and infrastructure record
- Traffic-controller event logs, timing plans, detection configuration, maintenance, malfunction, complaint, and work records
- Traffic cameras, nearby business or residential video, bus video, vehicle cameras, 911, dispatch, and body camera
- Roadway and signal plans, revisions, permits, temporary traffic control, construction, utility work, and inspection
- Crash history used carefully to identify patterns or notice without assuming that another event proves this one
Public video and controller data may not be kept indefinitely. A preservation request should identify the exact intersection, approaches, date, time window, and system without demanding unrelated surveillance.
Measure visibility dynamically
A photograph taken while standing at the corner may not represent a seated driver or moving rider. Account for eye height, vehicle pillars and mirrors, parked vehicles, queues, vegetation, signs, sun angle, darkness, rain, headlight glare, and the changing view as both participants move.
Distinguish conduct from design or operation
A participant may fail to look or yield even when the intersection functions as intended. Separately, timing, detection, sight restrictions, markings, maintenance, construction, or a malfunction may contribute. Identify the state or local jurisdiction, contractor, utility, adjacent controller, and record custodian before drawing a conclusion.
Test whether the alleged issue caused this conflict
An imperfect design feature is not enough without a causal path. Compare the claimed correction with the collision sequence: would it have changed detection, understanding, stopping, yielding, speed, or route in time to prevent the impact? State the assumptions and alternatives.
