When a passenger vehicle strikes the rear of a trailer, the condition and geometry of the rear-impact guard may become part of the investigation. The analysis is vehicle-specific. For trailers and semitrailers at or above the stated rating manufactured on or after January 26, 1998, the section refers to the versions of Federal Motor Vehicle Safety Standards 223 and 224 in effect when the vehicle was manufactured.

Do not apply a current dimension or a rule for one vehicle category to a different trailer without checking the definitions, manufacture date, historical rule text, certification, configuration, and exceptions. A low rear structure can qualify under an applicable provision for reasons that should be documented rather than assumed.

A missing, damaged, high, narrow, corroded, or deformed guard may raise questions, but a visual impression does not establish which requirement applied or whether a different condition would have changed intrusion, restraint loading, injury mechanism, or outcome.
