A truck-maintenance investigation should begin with the exact vehicle and component, not a general request for “all maintenance.” The useful record connects vehicle identity, control, inspection, a reported or discoverable condition, repair decisions, physical evidence, and the way a component could have affected the collision.
A maintenance file is useful only when the vehicle, component, date, defect, notice, work, custodian, and collision mechanism can be connected.
Identify every vehicle and custodian
- Tractor, straight truck, trailer, converter dolly, rental unit, substitute vehicle, and attached equipment
- VIN, unit number, plate, make, model, year, ratings, tire sizes, engine, mileage, hours, and configuration
- Owner, carrier, lessee, renter, driver, terminal, maintenance vendor, tire vendor, roadside service, and manufacturer
- Dates of possession and control, garaging location, dispatch, transfer, inspection, repair, and return to service
- Each paper and electronic system that stores schedules, complaints, defects, work orders, invoices, fault codes, and attachments
Use the systematic-maintenance rule precisely
49 C.F.R. § 396.3 addresses systematic inspection, repair, and maintenance for vehicles subject to a covered motor carrier’s control. For a vehicle controlled for 30 consecutive days or more, the rule identifies maintenance-record information including vehicle identity, the nature and due date of inspection and maintenance operations, and records of inspection, repair, and maintenance with dates.
The section includes record-retention provisions tied to the place where the vehicle is housed or maintained and to the period after the vehicle leaves the carrier’s control. Determine the rule that applied on the collision date, the actual control period, and whether relevant information also exists with a vendor, lessor, owner, or electronic platform.
Distinguish pretrip and periodic inspection records
49 C.F.R. § 396.13 addresses driver responsibilities before driving, including being satisfied that the vehicle is in safe operating condition and reviewing the last driver vehicle inspection report when required. 49 C.F.R. § 396.17 addresses periodic inspection at least once during the preceding 12 months and related documentation for covered vehicles.
A pretrip check, driver report, roadside inspection, annual inspection, preventive-maintenance interval, repair order, and post-repair verification serve different purposes. Ask for the form instructions, required fields, signature method, inspector qualifications where relevant, audit history, attachments, and links among those records.
Build a component chronology
- Brake measurements and adjustment, air systems, warnings, tires, wheels, hubs, steering, suspension, lights, mirrors, coupling, and safety systems
- Complaints, defect reports, roadside violations, sensor warnings, fault codes, out-of-service decisions, and repeat conditions
- Scheduled work, deferred work, parts ordered, work performed, technician notes, tests, invoices, approvals, and return-to-service decision
- Mileage and engine hours at each event, changes in units or odometers, missing intervals, imported legacy data, and later corrections
- Prior and post-crash photographs, measurements, downloads, removed parts, testing, expert observations, and chain of custody
Preserve the truck before condition changes
A repair record cannot replace inspection of the actual vehicle and component. Document the truck, trailer, tires, brakes, fluids, warnings, stored codes, event data, cargo, and impact damage before repair, cleaning, destructive testing, salvage, or disposal. Coordinate a reasonable inspection opportunity and keep removed components labeled with their source and custody history.
Test notice, work, and causation separately
A defect report may show notice without proving that the condition remained at impact. A completed work order may show a recorded repair without proving component condition. An overdue interval may be unrelated to the mechanism. Compare physical evidence, measurements, electronic data, driver actions, road conditions, load, speed, and alternative causes before assigning significance.
