Motorcycle crashes can involve turning vehicles, lane changes, rear impacts, roadway hazards, loss of control, animals, equipment conditions, or several events in sequence. A label such as “failure to see” or “rider error” does not explain the evidence by itself.

A cause category is only a starting hypothesis; the investigation must identify the movement, hazard, perception, response, equipment, and road conditions that produced the particular collision.

Begin with the event sequence

  • Each participant’s origin, destination, lane, path, speed, and traffic control
  • The first developing hazard and when it became detectable
  • Perception, decision, braking, steering, acceleration, and available escape path
  • Every contact, separation, fall, slide, secondary impact, and final position

Investigate intersection and turning conflicts

Map geometry, signal phase, stop or yield control, turn paths, sight lines, queued traffic, approach timing, and the conflict point. Determine whether another vehicle turned across the motorcycle, entered from a driveway, or screened it from view.

Investigate lane changes, merges, and overtaking

  • Blind spots, mirrors, pillars, traffic density, lane width, and relative position
  • Signals, headlight condition, conspicuity, and how long the motorcycle was observable
  • Closing speed, passing distance, lateral movement, and road markings
  • Device, navigation, dispatch, or other attention demands when lawfully available

Examine speed, spacing, and braking

Identify pre-event speed, following distance, traffic changes, grade, surface, braking onset, anti-lock system status, tire condition, and avoidance. A posted-limit comparison is not the entire conditional-speed or response analysis.

Preserve road and weather evidence

Sand, gravel, oil, water, ice, potholes, edge drop-offs, metal plates, debris, construction, drainage, wind, glare, and darkness can affect a two-wheeled vehicle differently from a passenger car. Record the exact location and condition before it changes.

Inspect the motorcycle and protective systems

  • Tires, wheels, brakes, steering, suspension, throttle, drivetrain, controls, lamps, mirrors, and modifications
  • Pre-event maintenance, warnings, repairs, recalls, prior damage, and post-crash handling
  • Helmet identity, certification markings, retention, damage, custody, and fit evidence
  • Jacket, gloves, footwear, eye protection, and other equipment when injury mechanism makes it relevant

Use safety sources without treating them as fault findings

Apply motorcycle-specific law accurately

G.S. 20-140.4 addresses identified passenger and helmet requirements and states that a violation is not negligence per se or contributory negligence per se in a civil action.

Test alternative causes

Compare rider conduct, other-driver conduct, roadway condition, mechanical failure, visibility, impairment, distraction, animals, cargo, and post-impact damage. State the evidence for and against each sequence and avoid inferring pre-impact failure from crash damage alone.

Connect the sequence to injury

Identify initial contact, rider motion, ejection, ground contact, secondary impacts, protective equipment, immediate symptoms, clinical findings, prior baseline, and later events. Crash severity does not substitute for medical causation evidence.
