A tractor-trailer air-brake system is a connected mechanical and pneumatic system. A loss of stopping performance can involve the tractor, one or more trailers, air supply, valves, chambers, pushrods, slack adjusters, linings, drums or rotors, hoses, couplings, warning devices, anti-lock components, maintenance, loading, or driver input.   • Coupling order, interchanged equipment, ownership, lease, operating carrier, maintenance provider, driver, and each custodian
  • Post-crash movement, towing, storage, air depletion, disassembly, repair, adjustment, testing, or part removal
  • Undisturbed photographs, measurements, scan data, removed parts, labels, fracture surfaces, wear, contamination, heat evidence, and chain of custody

Start with the applicable brake-system requirement

49 C.F.R. § 393.40 requires brakes adequate to stop and hold a covered commercial vehicle and addresses service, parking, and emergency systems. The applicable provisions depend in part on brake type and manufacture date. Identify the actual equipment before applying a standard.

A federal operating requirement is one part of the inquiry. The investigation should also examine the vehicle’s design information, manufacturer instructions, inspection criteria, service records, measurements, and the physical event. Compliance and civil causation are separate questions.

Measure components before they are changed

  • Separate collision-caused bending, severed lines, fire, towing damage, and disassembly from a condition that existed before impact
  • Preserve instruments, test settings, calibration information, photographs, notes, calculations, and the person performing each measurement
  • Compare the physical findings with driver reports, roadside inspections, annual inspections, repair orders, parts, technician notes, and return-to-service decisions

Test performance without overreading one number

49 C.F.R. § 393.52 addresses specified braking force, deceleration, and stopping-distance performance under stated test conditions. A crash-site stopping distance is not automatically a regulatory test result. Road grade, surface, loading, initial speed, brake application, steering, vehicle combination, anti-lock operation, and collision contacts can change the observed movement.

Synchronize mechanical and event evidence

  • Driver statement, dashboard warnings, audio, video, dispatch communications, and reported brake feel
  • Engine, event-data, telematics, anti-lock, and trailer-system records with documented clocks and field definitions
  • Road marks, debris, fluid or air-system evidence, vehicle paths, contact sequence, crush, and final positions
  • Load weight and distribution, tire condition, grade, weather, visibility, traffic, and available avoidance path
  • Each mechanical opinion, the inspected evidence, method, uncertainty, contrary information, and alternative explanation
