Record the exact vehicle and load rather than applying a generic cargo rule from memory. Photograph every side, end, restraint, contact point, damaged device, and load layer before unloading or alteration when safety and authority permit.

Review distribution and driver inspections

49 C.F.R. § 392.9 addresses cargo distribution and securement, pretrip assurance, an inspection within the first 50 miles for covered loads, and later reexamination at specified events or intervals, subject to exceptions.

A truck may be within gross limits but have an unsafe axle distribution or inadequate securement. It may be overweight while the restraint remains intact. Preserve scale tickets, axle weights, permits, loading records, suspension and tire evidence, and a technical explanation of how the alleged condition affected stability, braking, or containment.

Examine route forces and driving inputs

Map curves, ramps, grade, cross-slope, surface, potholes, braking, acceleration, steering, speed, weather, and evasive movement. Electronic data, cameras, telematics, witnesses, and roadway survey can help identify the forces before the load changed position.

Inspect the trailer and restraint system

  • Bunks, stakes, bolsters, frame, suspension, tires, coupling, and structural damage

Load movement may initiate loss of control, occur during driver response, result from impact, or continue afterward. Compare restraint failure surfaces, vehicle damage, marks, video, electronic events, witness accounts, cargo pattern, and reconstruction models.

Map each participant’s work

The loader may arrange the logs, the carrier may supply equipment and policy, the driver may inspect and adjust, a maintenance provider may service the trailer, and another party may control the site or route. For each, identify the actual task, information, authority, conduct, and causal link.

Preserve contrary explanations

An impact from another vehicle, trailer defect, road condition, sudden maneuver, or post-crash handling may explain some or all of the shift. A sound analysis records evidence that weakens the initial theory and the information needed to resolve it.
