A document index identifies what exists, where it came from, the period it covers, which version is available, and what remains missing. It should be concise enough to use while preserving the underlying files.
A consultation index is a map of source material, not a replacement for the original file, a medical conclusion, a factual stipulation, or proof that every document is complete and authentic.
Begin with a limited conflict-check packet
North Carolina Rule of Professional Conduct 1.18 addresses duties to a prospective client. Before a law office explains its conflict-check and intake process, avoid sending an unrequested archive. Start with the names and roles needed for conflicts, the general event type and date, approaching dates, and a short description of the legal task.
Give every item a reproducible index row
- Unique item number, descriptive name, category, source or custodian, creator, recipient, and date or date range
- Original filename, file type, byte size, page count or duration, native format, metadata preserved, and working-copy location
- Version, amendment, attachment, exhibit, translation, redaction, signature, certification, or completeness status
- Why the item may matter, without stating an unsupported conclusion about responsibility, causation, coverage, damages, or admissibility
- Missing predecessor or attachment, conflicting item, access restriction, request date, expected response, and person responsible for follow-up
Use categories that match the questions
- Parties and roles: identity, entity, ownership, employment, agency, contracts, property control, and contact information
- Event: incident report, photographs, video, audio, messages, witnesses, diagrams, physical evidence, device data, and inspection material
- Medical: evaluations, clinical notes, orders, results, images, referrals, therapy, restrictions, messages, discharge, and billing
- Insurance and benefits: policies, declarations, claims, acknowledgments, reservations, requests, decisions, payments, benefit statements, liens, and repayment notices
- Loss and function: work, wages, tax or business records when relevant, household assistance, expenses, property, daily function, and source calculations
- Legal and procedural: engagement or non-engagement, authority research, notices, demands, offers, releases, pleadings, service, discovery, orders, and deadline controls
Request medical records through the applicable process
45 C.F.R. § 164.524 addresses access to protected health information in a designated record set, subject to its procedures and exceptions. Record the facility, patient identity, date range, requested record categories, form and format, request date, response, omissions, and any amendment question. Keep the native delivery rather than converting every file into one flattened document.
Protect confidential and private material
North Carolina Rule of Professional Conduct 1.6 addresses confidentiality of information during representation. Before transfer, confirm the recipient, secure method, access controls, password channel, expiration, retention, and deletion process. Avoid including unrelated family, employment, tax, financial, medical, credential, or identity information merely because it exists in the same account or file.
Preserve contradictions and missing items
Do not delete a duplicate, older version, inconsistent date, unfavorable entry, or incomplete record from the index. Link related items and mark the difference as unresolved. A reviewer needs to know whether the conflict reflects a corrected entry, copied-forward text, different time zone, incomplete export, changed recollection, later information, or a genuine factual dispute.
Confirm delivery and the consultation result
Save the index version delivered, item count, total size, transfer method, recipient, timestamp, receipt confirmation, unreadable or omitted files, and follow-up request. After the consultation, record whether representation was accepted, declined, or remains under review; which materials will be retained or returned; and who remains responsible for evidence and deadlines.
