A rear-end collision can involve stopped traffic, sudden slowing, a lane change, work zone, disabled vehicle, poor visibility, grade, cargo movement, brake condition, or a sequence involving more than two vehicles. The point of contact is only one part of the event.

Rear contact identifies where vehicles touched; it does not by itself establish the pre-impact gap, hazard timing, speed, braking opportunity, vehicle condition, or every driver’s conduct.

Preserve the event scene

  • Final positions, contact damage, tire marks, debris, fluid, gouges, grade, curve, lanes, signs, and sight distance
  • Traffic, business, residential, responder, dash-camera, and vehicle video
  • Cargo, tractor, trailer, brakes, tires, steering, lamps, coupling, and post-crash custody
  • Witness positions, statements, traffic queue, warnings, road work, weather, and lighting

Place the hazard and response on one clock

  • When the lead vehicle or traffic condition became detectable
  • Speeds and lane positions before any braking or steering
  • Brake application, engine response, steering, warning, and impact timing
  • Electronic-data sampling, trigger logic, clock offsets, and uncertainty
  • Secondary impacts and forces that changed vehicle positions or damage

Apply the following-distance rule to conditions

G.S. 20-152 states that a driver shall not follow more closely than is reasonable and prudent, considering vehicle speed, traffic, and highway condition, and contains additional provisions. The analysis is contextual rather than a fixed universal distance.

Use speed evidence with care

G.S. 20-141 addresses speed restrictions and the duty to drive at a reasonable and prudent speed under existing conditions. Posted speed, actual speed, visibility, traffic, grade, weather, vehicle, load, and hazard timing can all be relevant.

Inspect braking and vehicle response

Document brake components and adjustment, air systems, warnings, tires, load, weight, maintenance, inspections, defects, repairs, and post-impact damage. Determine whether a condition existed before impact and whether it changed stopping or control.

Use qualified methods transparently

North Carolina Rule of Evidence 702 addresses opinion based on scientific, technical, or other knowledge and includes requirements concerning facts or data, principles and methods, and application. Preserve calculations, assumptions, validation, limits, and alternative scenarios.

Test alternatives before assigning responsibility

  • The lead vehicle entered the lane or stopped too late for avoidance
  • Visibility, traffic, weather, or roadway geometry shortened detection distance
  • A mechanical, tire, cargo, medical, or third-party event changed response
  • A secondary impact pushed one vehicle into another
  • Electronic or witness timing does not align with the physical record

Separate crash and injury analysis

Reconstruct vehicle interaction, then evaluate occupant movement, restraint use, contact, medical findings, prior conditions, symptoms, treatment, function, and other causes. Low visible vehicle damage does not independently resolve human injury, and severe damage does not identify every claimed condition.
