Commercial-driver fatigue and distraction are fact questions. A federal rule does not itself determine the cause or legal responsibility for a crash.

Federal hours-of-service rules

The current 49 C.F.R. Part 395 contains federal hours-of-service requirements for covered commercial motor-vehicle operations. Applicability, exemptions, logs, electronic records, and particular time limits depend on the regulation and the operation involved.

Preserve specific information

  • Vehicles, carrier identity, driver, route, cargo, photos, video, witness contacts, and report information
  • Electronic logging, dispatch, inspection, maintenance, communication, and employment records when available
  • Medical, repair, insurance, and expense records retained in their original form

The North Carolina crash-reporting guide covers one initial record. A Charlotte car-accident claim requires a fact-specific review.
