Recently Mr. Rosensteel was asked to comment on WSOC regarding the Covid 19 lawsuits. Mr. Rosensteel, an Attorney at Rosensteel Fleishman Car Accident & Injury Lawyers is a frequent contributor to local news programs.
During this broadcast the questions pertained to strategy when filing a lawsuit, including choice of venue. The reporter also wanted to know how the legal issues might play out surrounding the law suits.
Mr. Rosensteel explained that overall there are both legal and strategic reasons for filing suit in federal court versus state court and that such actions are sometimes filed with appellate courts in mind. Mr. Rosensteel also pointed out that the laws in North Carolina will be different than in other states, and that those small differences from jurisdiction to jurisdiction may change the outcome of the suit. Finally Mr. Rosensteel pointed out that the First Amendment protections surrounding the right to worship will be construed differently than those pertaining to the right to assemble, particularly assemblage for recreation (as opposed to the First Amendment right to assemble and petition the government for a redress of grievances).
