Pre-suit work may include investigation, preservation, medical and loss records, insurance claims, benefit coordination, legal research, demands, and negotiations. Filing a lawsuit adds pleadings, summonses, service, court orders, discovery, motions, mediation, and trial preparation. The transition should carry forward the source record without silently changing earlier facts or assumptions.
A lawsuit should not begin from a new, disconnected file; the pre-suit record should be reconciled into a litigation handoff that identifies what is verified, disputed, missing, privileged, produced, and deadline-sensitive.
Confirm scope and client objectives
North Carolina Rule of Professional Conduct 1.2 addresses scope and allocation of authority. Confirm whether the existing engagement includes filing, service, discovery, experts, mediation, trial, post-judgment work, or appeal; whether another lawyer or firm will participate; and which objectives and settlement decisions remain with the client.
Freeze the pre-suit record

- Work, wage, business, household, property, expense, benefit, lien, repayment, and net-recovery records with source calculations
- Policies, claims, reservations, decisions, payments, demands, offers, releases, communications, and every unresolved coverage or settlement term
- Preservation notices, response gaps, records requested, items unavailable, custodians, native files, hashes when used, and custody history
Prepare the complaint from verified inputs
North Carolina Rule of Civil Procedure 3 addresses commencement of a civil action. Before filing, reconcile the court, county and division, party names and capacities, claim theories, requested relief, factual allegations, attached materials, filing method, fee, summons plan, and deadline calculation. Mark allegations based on information still being investigated and obtain matter-specific legal review.
Convert the file into a discovery-ready map
Rule 26 addresses discovery scope, limits, sequence, protective orders, supplementation, and other discovery subjects. The handoff should identify likely custodians, systems, search periods, native formats, metadata, privileged or protected material, redaction questions, expert issues, unavailable evidence, and what has already been shared with an insurer or another party.
Separate file zones
- Source evidence preserved in its received or native form
- Working copies, annotations, summaries, chronologies, calculations, and draft demonstratives
- Attorney-client communications and material potentially protected as work product or otherwise privileged
- Documents already provided to an insurer, agency, opposing party, expert, mediator, or court
- Material withheld, redacted, disputed, incomplete, awaiting decision, or subject to a protective request
Reconcile dates and responsibilities
Carry forward statutes of limitation or repose, notice requirements, contract or insurance dates, preservation windows, offer expirations, summons and service dates, response dates, scheduling orders, discovery dates, expert dates, mediation, and trial settings. For each, record the authority, trigger, calculation, owner, backup owner, action, and completion evidence.
Issue a written handoff record
The handoff should state the file version, item count, omissions, new lawyer or team roles, scope, communication route, client decisions needed, deadlines, immediate tasks, unresolved risks, and confirmation that the receiving team can open the files. Preserve the prior index so later changes remain auditable.
