North Carolina workers’ compensation is a statutory system for covered employment injuries and occupational diseases. It is not simply an insurance plan whose benefits vary by carrier, and ordinary employee negligence does not generally decide whether a claim is compensable.
A useful workers’ compensation map separates coverage, compensability, claim status, medical care, disability benefits, return to work, and dispute procedure before deciding what the next step should be.
Start with the employment and coverage record
G.S. 97-2 defines terms including employee, employer, injury, disability, wages, medical compensation, and suitable employment. The legal employer may differ from the name on a uniform or jobsite sign, especially when staffing companies, contractors, related businesses, or borrowed employees are involved.
G.S. 97-13 identifies excluded employments and special categories. The general employee-count rule should therefore be checked against the employer’s legal identity, related entities, business activity, insurance, self-insurance, and any statutory exception rather than applied from a head count alone.
Identify the legal path for the condition
- A specific injury by accident arising out of and in the course of employment
- A back injury arising from a specific traumatic incident of the work assigned
- An occupational disease tied to the causes and conditions of the employment
- A later or additional condition alleged to result from the accepted injury or treatment
- A disputed nonwork, preexisting, independent-contractor, intoxication, misconduct, or notice issue that requires its own evidence
The event label does not decide the claim. Preserve the actual task, timing, location, mechanism, exposure, witnesses, symptoms, prior condition, medical chronology, and work relationship so the correct statutory path can be evaluated.
Separate reporting from filing
G.S. 97-22 addresses written notice of an injury to the employer and contains a 30-day rule with stated exceptions. An internal incident report helps document notice, but it is not the employee’s Industrial Commission claim.
The Industrial Commission’s forms directory identifies different forms for an employee claim, employer report, acceptance, payment without prejudice, denial, wage information, hearing request, and other events. Record the form number, filing date, sender, recipient, issue stated, and proof of delivery instead of treating every form as an approval or denial.
Read the claim status before assuming which benefits are owed
G.S. 97-18 distinguishes admitted claims, denials, payments without prejudice, required notices, and payment timing. Medical authorization, a weekly check, a claim number, or an employer report may be important without necessarily resolving every body part, diagnosis, disability period, wage calculation, or future treatment issue.
Keep the benefit categories separate
- Medical compensation: authorized evaluation, treatment, prescriptions, equipment, mileage, rehabilitation, and disputed care
- Total disability: wage-replacement benefits when the evidence establishes the applicable total-incapacity standard
- Partial disability: benefits tied to reduced wage-earning capacity under the governing rule
- Scheduled loss: compensation for listed body parts or functions under the statutory schedule
- Death benefits and burial expenses when the statutory conditions are met
- Third-party recovery when someone outside the employer relationship may also be legally responsible
A diagnosis, medical bill, impairment rating, work restriction, or missed paycheck can be relevant without being a complete benefit calculation. Maintain separate medical, work-status, wage, payment, and filing ledgers.
Use the map to choose the next task
- Verify employer and carrier identity, coverage, claim number, and accepted or disputed conditions
- Complete written notice and the employee filing record while preserving every applicable deadline
- Resolve urgent medical authorization, provider, diagnostic, treatment, or mileage issues
- Calculate wage and disability periods from payroll, restrictions, work offers, actual earnings, and payments
- Identify the exact disputed issue, missing evidence, Commission procedure, and next response date
