Document conditions on a common clock

  • Impact time, location, direction, lane, grade, curve, obstructions, and road-surface condition

  • Driver position, eye height, mirrors, windshield condition, wiper sweep, defrost, and washer operation
  • Speed, following distance, braking, steering, lane position, and warning sequence

Distinguish perception from response

A driver may not detect a hazard, may detect it late, or may perceive it but have insufficient time or distance to respond. Calculate the available sight distance and test reasonable perception and response assumptions. Do not infer inattention solely from a late brake application.

  • The hazard entered the lane too late to avoid
  • Spray or glare changed rapidly near another vehicle
  • Road geometry or a fixed obstruction blocked the view
  • The equipment worked but was used at an ineffective setting
  • A mechanical, tire, cargo, or roadway event affected control after detection

Connect visibility to the collision

A worn blade, lighting issue, or severe rain matters only if it affected the relevant view or response. State the evidence, the applicable rule, the field of view, the decision point, the available avoidance option, and the uncertainty. Keep equipment condition, driver conduct, and crash causation as separate analytical steps.
