An injury file may contain the same record as a portal download, scanned PDF, email attachment, printed copy, discovery production, summary, or later corrected version. A folder name such as “medical records” does not show which provider, date range, version, or pages are actually present.

A version-controlled document index should record the source, custodian, request, response, native filename, format, page range, creation date, received date, hash or other identifier, version relationship, restriction, and unresolved gap for every item.

Assign a stable document identifier

  • Document ID, category, descriptive title, source organization, custodian or sender, subject, event date, creation date, and received date
  • Native filename, file format, byte size, page count, beginning and ending page, attachment relationship, and whether the file opens completely
  • Original, duplicate, excerpt, corrected copy, amended record, later export, redacted copy, production copy, or working summary
  • Storage location, access restriction, encryption or password status, legal hold or preservation note, and person responsible for the copy

Index medical and billing records by designated record set

The U.S. Department of Health and Human Services explains that, with stated exceptions, the HIPAA Privacy Rule provides a right to inspect and receive copies of medical and billing records held by covered providers and health plans. Its medical-records guidance also addresses access, charges, psychotherapy notes, and amendment requests.

  • Provider and facility, department, date range, requested categories, authorization, request date, delivery date, and stated omission
  • Clinical notes, orders, imaging reports, images, laboratory results, therapy flowsheets, work notes, billing ledger, claim records, and correspondence indexed separately
  • Portal view compared with exported record, scanned page sequence compared with page numbering, and image-access information kept with the report
  • Amendment request, response, corrected entry, statement of disagreement, and original entry preserved as separate related documents

Preserve production context when litigation begins

North Carolina Rule of Civil Procedure 26 addresses discovery scope and methods, including documents, electronically stored information, custody, condition, location, and specified metadata. Discovery scope, privilege, protection, proportionality, and court orders are legal questions; an index is an organizational record, not a decision about what must be produced.

Rule 34 addresses requests for documents, electronically stored information, tangible things, and inspection. It permits requested forms for electronic information and states production-organization rules. Track request number, requested category, objection, response, production date, production range, native item, replacement production, and the exact copy sent or received.

Keep authenticity questions visible

North Carolina Rule of Evidence 901 states the general authentication requirement and gives nonexclusive illustrations. Renaming, converting, printing, annotating, cropping, or summarizing a file may affect how its identity is later shown. Preserve the original available file and record every transformation.

  • Sender and recipient, delivery channel, message headers, original attachment, download source, export settings, and collection date
  • Native file and working copy kept separate, with a transformation note for OCR, redaction, rotation, compression, conversion, annotation, or exhibit marking
  • Duplicate detection based on content and identifiers rather than filename alone
  • Authentication, hearsay, privilege, confidentiality, admissibility, and discoverability left as separate review fields rather than assumed from possession

Use an exception log for incomplete or conflicting sets

  • Missing page, unreadable page, omitted attachment, broken link, incomplete date range, absent image, or unexplained numbering gap
  • Two files with the same name but different content, or the same content with different page numbering
  • Later correction without the earlier version, summary without source record, or invoice without corresponding service record
  • Requested record not received, custodian unknown, access denied, response overdue, or limitation requiring legal review
