Motorcycle brakes and lights can affect stopping, control, visibility, and communication with other road users. They can also be damaged at impact, during towing, or during later repair. Apply the brake statute to the involved motorcycle

G.S. 20-124 addresses brakes on vehicles operated on a highway and includes a motorcycle-specific requirement. Document the system actually installed, front and rear control operation, hydraulic or mechanical condition, wear, leakage, adjustment, tire contact, surface, speed, load, and available stopping distance. A statutory issue does not establish when a defect arose or whether it changed the event.

Document headlamp, rear-lamp, and stop-lamp function

G.S. 20-129 contains motorcycle headlamp, rear-lamp, and stop-lamp requirements. Preserve bulb or LED assemblies, lenses, mounts, wiring, switches, power, aiming, contamination, post-impact damage, and any automatic-lighting system. Test only under a recorded protocol that states what was repaired, powered, repositioned, or unavailable.

Use inspection criteria as a condition checklist

The NCDMV safety-inspection page identifies items examined during the State program, including headlights, accessory lights, signals, foot brakes, steering, tires, horn, and rearview mirrors. Obtain the actual electronic inspection history and station record. A prior pass does not prove collision-date condition, and a later fail may reflect impact damage or later change.

Reconstruct visibility, stopping, and response separately

  • Compare lamp evidence with ambient light, weather, glare, background contrast, road geometry, obstructions, observer position, attention, and sight duration

  • Test whether another driver’s movement, roadway condition, weather, rider input, or post-impact damage better explains the evidence
  • Separate equipment compliance, inspection status, notice, maintenance, conduct, collision causation, injury causation, and damages
