A truck-weather investigation should reconstruct the conditions at the vehicle, not rely on a regional forecast or a general statement that it was raining. Weather, road treatment, traffic, visibility, traction, wind, grade, speed, tires, brakes, load, vehicle configuration, driver decisions, and dispatch information can change along a route and over minutes. Each source should be time-aligned to the collision.
A weather alert or wet roadway does not establish what the driver encountered, what was reasonably knowable, how the vehicle responded, or whether a different decision would have changed the crash.
Build a time-and-location weather record
- Exact collision coordinates and time, direction of travel, route, elevation, bridge or open area, curve, grade, lane, shoulder, work zone, and nearby reporting sites
- Precipitation, temperature, wind, visibility, fog, smoke, dust, sun angle, surface water, ice, snow, slush, spray, treatment, friction, drainage, and changing conditions
- Forecasts, warnings, radar, station observations, road sensors, traffic cameras, maintenance logs, treatment records, closure notices, 911, witnesses, and original media
- Truck speed, acceleration, braking, steering, stability-control and ABS events, gear, engine retarder, following distance, lane path, lights, wipers, tires, and load movement
- Driver observation, training, experience, rest, dispatch, route choice, stop locations, messages, calls, navigation, customer schedule, and carrier instructions
Apply the hazardous-condition driving rule separately
49 C.F.R. § 392.14 requires extreme caution when hazardous conditions such as snow, ice, sleet, fog, mist, rain, dust, or smoke adversely affect visibility or traction. Its current text calls for reduced speed and discontinuing operation when conditions become sufficiently dangerous, with a passenger-safety qualification. Document the condition, visibility or traction effect, available alternatives, speed change, stop decision, and event sequence rather than asserting that any precipitation establishes a violation.
Do not confuse hazardous operation with the hours exception
49 C.F.R. § 395.2 defines adverse driving conditions for the hours-of-service rules. The definition concerns specified weather or unusual road or traffic conditions that were not known, or could not reasonably have been known, to the driver at the relevant pre-duty or post-rest point or to the carrier immediately before dispatch. Preserve what forecasts, alerts, route information, messages, and observations were available to each participant and when.
49 C.F.R. § 395.1(b)(1) describes a limited extension of driving or duty time when a driver encounters qualifying adverse driving conditions and cannot safely complete the run within the otherwise applicable time. The hours exception does not authorize unsafe operation, replace § 392.14, or establish that conditions caused a collision. Identify the driver category, normal limit, qualifying condition, added time, destination or safe location, ELD entries, annotations, and carrier knowledge.
Preserve the vehicle and decision records
- Original dashcam and roadside video, ELD, engine and event data, telematics, stability-control and ABS data, diagnostic codes, navigation, and mobile-device records
- Tire make, model, size, tread, inflation, load, age, damage, chains; brake condition and adjustment; lamps, wipers, defroster, mirrors, camera, and sensor condition
- Pretrip, roadside, periodic, maintenance, repair, complaint, driver-report, dispatch, route, delay, detention, customer, and safety-policy records
- Road design, drainage, friction, treatment, construction, signs, speed limits, warnings, closures, prior incidents, and roadway-authority records
- Post-crash tow, storage, repair, tire inflation, data download, cleaning, testing, parts removal, salvage, and every custody transfer
Reconstruct choices and alternatives
- When the condition first became observable and how it changed visibility, traction, traffic, and route progress
- Whether speed, following distance, lane, lights, wipers, braking, steering, stopping, parking, rerouting, or delay decisions changed
- Whether dispatch knew or should be evaluated for the information it actually received, and what guidance or pressure was communicated
- Whether vehicle condition, load, another road user, road design, weather, response, or a combination explains the movement
- Separate forecast availability, observed condition, regulatory applicability, participant conduct, vehicle dynamics, collision cause, and medical causation
