Truck-weight evidence can include certified and private scale tickets, axle readings, manifests, bills of lading, loader records, permits, route documents, photographs, vehicle specifications, telematics, and physical cargo. Each source answers a different question. A stated shipment weight is not necessarily an axle weight or the vehicle’s weight at the collision.

A scale ticket or special permit can document stated weights, dimensions, route, dates, equipment, or conditions, but it does not by itself establish the truck’s actual configuration at impact or that weight caused the collision.

Identify the vehicle, load, and measurement event

  • Tractor, trailer, dolly, axle group, VIN, unit and plate numbers, configuration, ratings, tire capacities, and suspension state
  • Commodity, packaging, pallets, containers, fluids, fuel, equipment, passengers, load position, additions, removals, delivery, and spill
  • Scale operator, location, date, time, ticket number, device, calibration or certification record, weighing method, axle placement, and reweigh
  • Steer, drive, trailer, tandem, single-axle, gross, tare, net, stated, estimated, and permitted values kept in separate fields
  • Route, road class, bridge, posted restriction, origin, destination, stop, detour, permit condition, and actual path

Apply the law for the place and operation

49 C.F.R. § 392.2 requires commercial vehicles to be operated in accordance with the laws, ordinances, and regulations of the jurisdiction, while requiring compliance with a higher applicable FMCSA standard. The roadway, vehicle, trip, cargo, permit, and date must be identified before selecting a rule.

N.C. Gen. Stat. § 20-118 contains North Carolina vehicle-weight provisions, definitions, measurement rules, tolerances, and enforcement details. Use the current statute and any other applicable federal, state, local, bridge, or roadway restriction rather than applying one limit to every truck.

Read a special permit as a set of conditions

N.C. Gen. Stat. § 20-119 addresses special permits for vehicles or loads exceeding otherwise applicable size or weight limits. A permit should be reviewed for the named applicant, vehicle and load, effective date, route, dimensions, weights, axle configuration, escorts, speed or travel conditions, and any incorporated documents.

Reconstruct weight at the causal time

  • Compare the ticket with loading records, cargo count, bills, seal, photographs, fuel, route stops, deliveries, pickup, spill, and post-crash unloading
  • Check whether the truck was weighed before or after a load change and whether every relevant unit was on the scale
  • Document measurement precision, calibration, placement, dynamic versus static method, transcription, duplicate tickets, and inconsistent identifiers
  • Evaluate braking, steering, rollover threshold, tire and suspension loading, bridge or pavement interaction, visibility, speed, grade, curve, wind, and securement using qualified methods where needed
  • Separate a limit or permit issue from whether the weight distribution or amount contributed to this event
