Cargo can contribute to a truck collision by falling or spilling, shifting enough to affect stability or maneuverability, changing axle loading, striking a door or structure, or altering the vehicle’s response during braking or turning. The investigation begins with the actual commodity, packaging, weight, distribution, vehicle, securement system, loading process, inspections, route, and event sequence.

A load-securement investigation should connect the actual cargo, vehicle, securement system, loading and inspection sequence, trip forces, physical movement, participant conduct, and collision mechanism rather than infer an unsafe load from the crash alone.

Preserve the load and securement system

  • Commodity, package, dimensions, weight, center of gravity, pallet, container, seal, dunnage, blocking, bracing, tarp, door, bulkhead, and loading diagram
  • Vehicle and trailer VINs, unit numbers, deck or body configuration, anchor points, walls, floors, doors, suspension, axle weights, gross weight, and ride condition
  • Each chain, strap, rope, binder, bar, mat, corner protector, fastener, anchor, marking, rating, length, location, tension, wear, cut, crack, bend, corrosion, and fracture
  • Undisturbed photographs, video, scans, measurements, cargo and debris locations, roadway marks, spill and cleanup records, removed items, and chain of custody
  • Loader, shipper, carrier, driver, broker, owner, warehouse, receiver, equipment provider, maintenance provider, and the task each actually performed

Identify the inspection duty and its exceptions

49 C.F.R. § 392.9 addresses cargo distribution, securement, equipment, and driver inspection for covered operations. The current provision includes a review before driving, an inspection within the first fifty miles, and reexamination after specified duty-status, time, or distance events, with exceptions for certain sealed vehicles or cargo loaded so inspection is impracticable.

The presence of a seal does not answer who loaded the cargo, what the driver could observe, whether weight or distribution information was available, whether an exception applies, or whether another participant had a separate responsibility. Record each participant’s access, knowledge, instruction, and control.

Separate loss-of-load and load-shift questions

49 C.F.R. § 393.100 applies the cargo-securement subpart to stated commercial-vehicle types. It requires covered cargo to be loaded and secured to prevent leaking, spilling, blowing, or falling and to prevent shifting enough to adversely affect stability or maneuverability.

Evidence of a spill can differ from evidence of an internal shift. For an enclosed trailer, preserve interior marks, floor and wall damage, pallet positions, load bars, seals, door condition, photographs from loading and delivery, trailer movement data, and any post-crash unloading record.

Evaluate devices and forces using the applicable cargo rules

49 C.F.R. § 393.102 provides minimum performance criteria for cargo-securement devices and systems, including stated directional force criteria, working-load concepts, and vertical restraint for cargo not contained within the vehicle structure.   • Identify the applicable general and commodity-specific provisions before calculating device count or capacity
  • Document manufacturer markings, working-load limits, device condition, attachment points, angles, indirect or direct method, friction assumptions, and containment
  • Use actual cargo dimensions, weight, orientation, distribution, and vehicle structure rather than a generic load description
  • Distinguish pre-impact looseness or movement from movement caused by evasive action, road contact, rollover, impact, rescue, towing, or cleanup
  • State inputs, method, uncertainty, sensitivity, contrary evidence, and qualifications for any engineering or dynamics opinion

Build a loading-and-movement chronology

  • Tender, loading, weight check, seal, departure, first-fifty-mile inspection, later reexaminations, stop, warning, route event, collision, spill, response, and unloading
  • Record or witness for each step, who performed it, what was observed, and what was changed
  • Cargo position and securement condition at the earliest reliable point and after each significant event
  • Speed, braking, steering, curve, grade, crosswind, surface, prior cargo movement, vehicle condition, and alternative cause
  • Specific alleged act, participant, applicable duty, supporting and contrary evidence, and connection to the collision sequence
