A commercial truck striking the rear of another vehicle raises immediate questions about following distance and response. The physical contact alone does not establish every fact about why the vehicles came together or how each claimed injury occurred.

The location of rear impact is an important fact, but it does not replace reconstruction of following distance, visibility, perception, response, and vehicle condition.

Reconstruct the traffic sequence

  • Traffic flow, queue formation, stopping vehicle, lane changes, merge, ramp, signal, or work-zone activity
  • Truck speed, following interval, sight distance, obstruction, grade, curve, weather, lighting, and pavement
  • When the hazard could be perceived and when the driver actually responded
  • Throttle, brake, steering, warning, impact, secondary impact, and final position
  • Movement of the lead vehicle and any third vehicle before or during the sequence

Apply the following-distance rule to the conditions

North Carolina G.S. 20-152 states that a driver may not follow another vehicle more closely than is reasonable and prudent, considering vehicle speeds, traffic, and highway condition. It also contains additional provisions and a commercial-vehicle platoon exception under stated conditions.

The statute does not supply one universal number of seconds or feet for every event. Vehicle weight, speed, grade, traffic, weather, visibility, tires, brakes, and expected hazards can change the safe interval.

Evaluate speed beyond the posted limit

G.S. 20-141 addresses numerical limits and reasonable and prudent speed under existing conditions and actual or potential hazards.

A truck may be below the posted limit but still require more distance for a known queue, rain, darkness, grade, construction, or congestion. Conversely, stopping distance should be calculated from supported inputs rather than assumed from vehicle size.

Preserve electronic and physical evidence

  • Event, engine, brake, stability, collision-warning, automatic-braking, camera, and telematics data
  • Electronic logs, dispatch, phone, navigation, fuel, toll, and route information
  • Scene video, traffic cameras, dash cameras, 911, witness accounts, marks, debris, and final positions
  • Truck and lead-vehicle damage, lamps, brakes, tires, steering, restraints, and post-crash movement
  • Native files, metadata, time settings, calibration, download method, and chain of custody

Test braking and warning performance

Determine whether the driver applied brakes, when braking began, whether the tractor and trailer responded, and whether antilock, stability, collision-warning, or automatic-braking systems generated data or warnings. A warning-system presence does not establish that it functioned, detected the hazard, or could prevent impact.

Consider other causal participants

Another vehicle may enter the gap, a lead vehicle may stop for a hazard, a work zone may create an unexpected queue, or a mechanical condition may lengthen response. A carrier, maintenance provider, equipment actor, roadway entity, or another driver requires a conduct-and-causation basis rather than inclusion by association.

Use reconstruction opinion with a foundation

North Carolina Rule of Evidence 702 requires sufficient facts or data, reliable methods, and reliable application and includes a provision concerning qualified crash-reconstruction opinion on speed with a proper foundation.

Document measurements, weights, drag or friction assumptions, brake and tire condition, time intervals, data definitions, uncertainty, and alternative scenarios. Explain how sensitive the conclusion is to a changed input.

Separate collision cause from medical cause

Rear vehicle damage, occupant motion, restraint, head restraint, prior conditions, symptom timing, examination, diagnosis, treatment, and qualified medical analysis may all matter. A low or high repair estimate alone does not diagnose a person.

Address defenses directly

Evaluate claims about a sudden stop, disabled lights, unsafe lane change, road condition, visibility, contributory conduct, preexisting health, treatment gap, or later event. Preserve evidence that supports or contradicts each assertion.
